These Conditions of Purchase together with the Legal Notice and Privacy Policy (collectively, called "Terms and Conditions") regulate the purchase and sale of the services and products offered by Nova Baixas, S.L ("BAIXAS" or "We") to your Customers ("Customer" or "You") through the Website (hereinafter the "Site"). These Conditions have been drawn up in accordance with the provisions of Directive (EU) 2011/83 of the European Parliament and of the Council of 25 October 2011 on consumer rights; Directive (EU) 2019/771 of the European Parliament and of the Council of 20 May 2019 on certain aspects of contracts for the sale of goods, Law 34/2002 on Information Society Services and Electronic Commerce, Law 7/1998 on General Contracting Conditions, Royal Legislative Decree 1/2007, of 16 November, approving the Consolidated Text of the General Law for the Protection of Consumers and Users and other complementary laws and Law 7/1996 on the Regulation of Retail Trade.
It is important that you read and understand each of the clauses of the Conditions of Purchase of BAIXAS. In the event that you do not agree with one or more of these clauses, you will not have to move forward with the purchase process.
The validation of the order by the Customer expressly implies knowledge and acceptance of these Purchase Conditions as part of the conclusion of the contract.
Unless proven otherwise, the data required by BAIXAS They constitute proof of the set of transactions carried out between BAIXAS and its Customers.
1. ABOUT OUR PRODUCTS AND SERVICES
Through the Web, BAIXAS It offers you the possibility of buying pastry, pastry and chocolate products. The information and specifications of each available product are described on the Web.

2. PROCEDURES FOR PLACING THE ORDER
The purchase process is very intuitive but if at any time you encounter difficulties or receive an error message, you should contact BAIXAS.

Once you have added an item to your shopping cart, you can continue browsing or finalize the purchase. You can access the contents of your shopping cart at any time by clicking on the shopping cart button in the upper right corner of the page.

Subsequently, you must choose the date and time of delivery of the order and enter the data of the bank card where you want the payment of your order to be made and accept these Purchase Conditions together with the Privacy Policy of BAIXAS.
Finally, you must click on the "Place order" button to proceed with the payment of your purchase, at which time you will be redirected to a secure payment gateway to finalize your purchase.
Once the payment has been confirmed, you will receive an email confirming that the order has been placed. If you have not received the confirmation email in your email when placing an order, it may be due to a specific technical problem. The normal thing is that it arrives after a few minutes. 3. PRICE AND PAYMENT METHOD
The prices of the products and taxes for each speciality will be those established on the Website for each product. All prices published on our website include VAT and other taxes that may be applicable. Prices are always expressed in Euros (€).
The prices shown for each product do not include shipping costs, shipping insurance or any additional service to the product purchased, unless otherwise indicated. Any of these additional expenses that are applicable will be shown to the Customer in the breakdown of their shopping cart, before proceeding to pay for it.
By accepting these Conditions of Purchase, the User accepts that the economic valuation of some products offered may vary in real time. In any case, this will always be communicated prior to the formalization of the purchase.
The User undertakes to pay at the time of placing the order. To make the payment, the Customer will be redirected to a secure payment platform. Payment can be made by credit card or Visa or Mastercard. BAIXAS It does not offer the possibility of financing the purchase of any of its products.
Once the payment has been made, the User will receive an order confirmation e-mail, which includes a summary of the items purchased, the shipping method and the destination address.

4. CONDITIONS ON PROMOTIONS
BAIXAS you may periodically make discount codes available to your Customers. These discounts may only be applied in accordance with the rules specified by BAIXAS respect for each code. The offers, promotions and / or discount codes will not be combinable with each other and may not be compatible with certain product collections.

5. FORM, COSTS AND DELIVERY TIME.
The products may be collected by the Customer directly in the store at no additional cost or may be sent to an address of their choice. Provided that the order is placed 48 hours in advance and exceeds € 40 (FORTY EUROS), BAIXAS It offers home delivery between 10:00 a.m. and 2:00 p.m. from Monday to Sunday.
For orders lower than the amount indicated above, the Customer must pick up the order placed in store.
Transport costs may be known by the Customer at the time of confirming the order, depending on the shipping address indicated. The cost of transport is free for orders over € 60 (SIXTY EUROS), (only for individuals).
BAIXAS It makes home deliveries in the Metropolitan Area of Barcelona, which includes: Barcelona, L'Hospitalet de Llobregat, Badalona, Santa Coloma de Gramanet, Sant Cugat del Vallés, Cornellà de Llobregat, San Boi de Llobregat, El Prat de Llobregat, Esplugues de Llobregat, Sant Feliu de Llobregat, Sant Adrià de Besòs, Sant Joan Despí and Sant Just Desvern.

When the Customer has opted for home delivery, BAIXAS He will deliver the order to the address indicated by him in the purchase form. BAIXAS does not assume any responsibility when the delivery of orders is not made as a result of the data provided by the Customer being false, inaccurate or incomplete, as well as any other cause attributable to the Customer.
The delivery time will be that indicated to the Customer in the breakdown of his shopping cart, before proceeding to the payment of this. Confirmation of payment, by any of the methods enabled, is an essential condition to maintain the indicated delivery times.
The delivery of the order will be considered made from the moment in whichBAIXAS or the contracted transport company makes the product available to the Customer.
BAIXAS It will carry out all the necessary actions so that the delivery is made within the agreed period, although the delivery time may be terminated for logistical reasons.
IfBAIXAS is unable to deliver the products purchased within the indicated period, will notify this circumstance to the Customer, informing him of the new period in which they will be available. The Customer will have the possibility to terminate the order and request a refund of the amount paid. In such a case,BAIXAS will refund the amounts paid as soon as possible, within a maximum period of 14 (fourteen) days from when the Customer had requested the refund, by the same form of payment initially chosen.
In the event that the Customer detects any problem at the time of delivery of his order (damaged packaging, erroneous, missing or damaged products) he must contact by e-mail with our Customer Service department at Services@baixas.es or by calling 932 092 542, within 24 hours of reception.
6. UNAVAILABILITY OF THE PRODUCT
The selection of products offered byBAIXAS is valid as long as the products are visible on the Website, within the limits of available stock. If the contracted product is not available due to lack of stock or inability to prepare the requested product due to lack of time,BAIXAS It will inform you of this and you can request a refund within a maximum period of 14 (fourteen) days of the amounts you have paid.
7. RIGHT OF WITHDRAWAL
The right of withdrawal does not apply to products purchased through our website in accordance with article 103 section e) of Royal Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws. 8. DEFECTIVE PRODUCTS AND ERRONEOUS ORDERS.
BAIXAS guarantees that the products you sell comply with the descriptions, characteristics, information and specifications published on our website. However, sometimes it can happen that a product turns out to be defective.
In case of receiving a defective product, the Customer must contact by sending an email addressed to Services@baixas.es and send us a photo clearly showing the damage.
In case of receiving an order that does not correspond to what has been purchased or in which any of the products purchased is missing, the Customer must contactBAIXAS by sending an email to Services@baixas.es attaching an image showing the products received together with proof of payment and shipping.
Once it has been verified that the product is really defective and/or that the content and order actually placed are erroneous (as appropriate),BAIXAS will contact the Customer to offer a solution.
In the event that the Customer chooses to obtain a refund, he must return the product toBAIXAS If you have consumed it, in its original box or container and with the labels that accompanied it.BAIXAS It takes care of the costs of returning the product.
In cases of erroneous orders, once receivedBAIXAS will verify that the product is in good condition and proceed to refund the amounts paid in accordance with these Conditions.
9. REFUND OF AMOUNTS PAID
When, in accordance with these Purchase Conditions, the Customer is entitled to a refund of amounts paid, it will be notified by email and the refund will be made through the means of payment used in the purchase. BAIXAS The amount will not be refunded until the receipt and status of the product object of the return have been verified. Once the returned product has been verified,BAIXAS It will proceed to refund the amount within a maximum period of 14 (fourteen) days.
10. GENERAL INFORMATION
According to current legal regulations, consumers or users are natural or legal persons acting in an area outside a business or professional activity. For this reason, some of the clauses provided for in these Terms of Purchase may apply exclusively to end consumers. When the Customer is a company or entity, some of the clauses contained in this document will not apply, but those legally established for habitual sale contracts.
BAIXAS It will archive the electronic document in which it is formalized in the contract. The same will not be accessible to the Customer through the Website, but the Customer may request a copy of it by contacting our Customer Service department by email Administration@baixas.es.
The contract and documents related to the purchase of the products may be made in Spanish or English. In case of doubt or contradiction, the Spanish version will prevail over the others.
11. CUSTOMER SERVICE
Customers may direct their doubts, complaints or claims toBAIXAS by postal mail, email or through the telephone number provided on the Website. BAIXAS undertakes to provide a response to the Customer as soon as possible.
12. MODIFICATIONS OF THESE PURCHASE CONDITIONS
BAIXAS reserves the right to modify these Conditions of Purchase without affecting the products or services purchased through the Website prior to such modification.
13. APPLICABLE LAW AND JURISDICTION
These Conditions of Purchase are governed by Spanish law. The parties submit to the resolution of conflicts arising from the current contract the courts and tribunals of Barcelona, or in those of the Client's domicile in the event that he is considered a consumer by Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws.
