In compliance with article 10 of Law 34/2002, of July 11, on Services of the Information Society and Electronic Commerce (LSSI-CE), we inform you that the owner of the website https://baixas.es (hereinafter, the “Web”) is Nova Baixas, S. L, domiciled at C/Muntaner, 331, CP 08021 Barcelona, with C.I.F B55177950 and registered in the Mercantile Registry of Girona Volume 2933, Folio 200, Section 8, Sheet GI 55425 (hereinafter, “BAIXAS”).

The communications that are necessary between BAIXAS and the User, must be addressed to the Customer Service by sending an email to serveis@dev.baixas.es, calling the number 616 33 53 53 or 932 09 25 42, or by sending a written communication addressed to our Customer Service Department, to the aforementioned address.

Our customer service hours are from Monday to Saturday from 8:00 a.m. to 8:30 p.m. and on Sundays from 8:00 a.m. to 3:00 p.m.

1. Acceptance of the conditions of use

1.1. These Terms of Use are intended to regulate the provision of information and services provided by BAIXAS through the Web.

1.2. By browsing the Website, you automatically acquire the status of User (hereinafter, “Ud.” or “User”) and accept without reservation of any kind, each and every one of this Legal Notice.

1.3. To start using the Web, it is not necessary for the User to register previously, nor to expressly accept this Legal Notice. However, the User is aware that it is their obligation to know and respect this Legal Notice and our Privacy Policy from the moment they access the Web.

1.4. BAIXAS may modify this Legal Notice by publishing these modifications on the Web so that they can be known by the Users.

2. Intellectual property rights

2.1. All the content of the Web, including but not limited to its programming, editing, compilation, designs, logos, images, text and graphics, are the property of BAIXAS, and are protected by national and international regulations on intellectual property. Access by the User does not grant you any right of ownership.

2.2. If you see on the website any content that could violate intellectual and industrial property rights, please notify BAIXAS as soon as possible, by sending an email to serveis@dev.baixas.es

3. Civil Liability

3.1. BAIXAS will not be liable for any damage or harm that the User may suffer as a result of the use of the Web when it proves that it has met the requirements and diligences required by the nature of the Web.

3.2. We do not control, in general, the use that Users make of the Web. In particular, we do not guarantee under any circumstances that the Users use the Web and its tools in accordance with the law, this Legal Notice, morality and generally accepted good customs and public order, nor that they do so diligently and prudently.

3.4. In the event that links or hyperlinks to other Internet sites are available on the Web, we will not exercise any type of control over said sites and contents. In no case will we assume any responsibility for the contents of any link belonging to an external website, nor will we guarantee the technical availability, quality and veracity of any material or information contained therein.

4. Exclusion of guarantee

4.1. We do not guarantee that the Web will run without interruptions, in useful time, reliable, error-free or virus-free and we are not responsible for any damages that may arise from interferences, omissions, interruptions, computer viruses or disconnections in the operating system of this electronic system, caused by causes beyond the control of BAIXAS.

4.2. It is the responsibility of the User to adopt all appropriate technical measures to reasonably control these risks and avoid damage to their equipment, loss of data and theft of confidential information. For these purposes, you must have updated malware detection systems, such as viruses, Trojans, etc., as well as have updated the security patches of the corresponding browsers you use.

5. Obligation of Users

The User undertakes to:

5.1. Provide true data to all forms on the Web and keep this data updated. The User undertakes not to use false identities, nor to impersonate the identity of others in the use of the Website.

5.2. Not to use images or information as defamatory, insulting, obscene, threatening, xenophobic, that incite violence to discrimination based on race, sex, ideology, religion or that in any way violates morality, public order, fundamental rights, public freedoms, honour, privacy or the image of third parties and, in general, current regulations.

5.3. Not to introduce, store or disseminate any content that infringes intellectual and industrial property rights, the secrecy of communications and the legislation on the protection of personal data;

5.4. Do not use the website to carry out advertising, promotional or commercial activities.

5.5. Not to introduce, store or disseminate any computer program, data, viruses, code, hardware or telecommunications equipment or any other electronic or physical instrument or device that is likely to cause damage to the Web or prevent its normal operation.

5.6. Do not destroy, alter, use for its use, disable or damage the data, information, programs or electronic documents of BAIXAS, its suppliers or third parties.

5.7. Not to introduce or disseminate any false, ambiguous or inaccurate information and content in a way that misleads the recipients of the information.

6. Underage

In general, to use the service minors must have previously obtained the authorization of their parents, guardians or legal representatives, who will be responsible for all acts carried out through the website by minors in their charge. In the services in which it is expressly indicated or determined by law, access will be restricted solely and exclusively to people over 18 years of age.

7. Duration and termination

The provision of services has an indefinite duration. Without prejudice to the foregoing, we are entitled to terminate, suspend or unilaterally interrupt, at any time and without prior notice, the commercialization of our products.

8.Applicable law and jurisdiction

This Legal Notice is governed by Spanish law. The parties submit, at their choice, for the resolution of conflicts and waiving any other jurisdiction, to the courts and tribunals of the domicile of Barcelona.
